Terms and conditions of Prisma Konto loyalty program

1. Parties

These terms apply between the customer and Prisma Peremarket AS (hereinafter "Prisma") when joining or using the loyalty program. The loyalty program is intended for consumers aged 16 years and above. Discounts are determined based on purchasing behaviour, and the program is personalized.

2. Detailed content of the loyalty program

We offer you personalized discounts and promotions free of charge. Discounts and promotions are subject to change without prior notice. The specific discounts of the loyalty program are determined according to the applicable rules and may also include discounts offered by our partners. Data is processed in accordance with the Privacy Policy and may be used, among other things, for more detailed analyses, optimizing services and product selection, as well as for targeting or marketing discounts. We may also send you surveys based on your purchases.

The rules of the loyalty program may be changed at any time without prior notice.

While you use the loyalty program, we collect data about your store visits, purchased products, services consumed, quantities, discounts used, receipt totals, payment transaction, and other relevant information. Additionally, if you're a registered user, we may also collect network behaviour data from the customer program applications, in the extent permitted by applicable law.

3. Your obligations

It is your responsibility to provide correct contact details, update them when necessary, and use the loyal program in compliance with these terms and applicable legal regulations.

4. Termination and cancellation of the agreement

The agreement can be cancelled at any time via the online service by selecting "Close Konto" or by visiting customer service. The cancellation will take effect immediately and will also terminate the validity of the agreement.

5. Termination and modification of the loyalty program

You can cancel your participation in the loyalty program at any time. Peremarket has the right to terminate the program with a 10-day notice or immediately for a valid reason. Peremarket may also restrict access to the loyalty program.

The terms and conditions of the agreement may be renewed. You will be notified of any significant changes to the terms and conditions in a suitable manner. If you have not used the loyalty program for more than two years, Peremarket may terminate the agreement and permanently delete your data.

6. Dispute resolution and liability for damages

If any disputes related to these terms and conditions cannot be resolved through negotiations between the parties, the customer may refer the matter to the Estonian Consumer Protection and Technical Regulatory Authority or file a lawsuit in the competent first-instance court of their place of residence. Additionally, the customer has the option to initiate the handling of consumer protection issues via the online dispute resolution platform managed by the European Commission at http://ec.europa.eu/consumers/odr/.

You are entitled to compensation for direct and immediate damages resulting from an error related to the service under this agreement, in accordance with the provisions of the Estonian Consumer Protection Act. However, we are not liable for any indirect damages incurred. The liability to compensate is limited to damages that are compensable under the Consumer Protection Act, and we are not liable for other damages. The limitations of liability do not apply to compensation obligations arising from separate warranty commitments applicable to us.
